What a registered will in the UAE settles — and what it does not
The point almost everyone postpones because it is uncomfortable. Without provision, the succession law of your country of residence does not automatically govern your assets in the Emirates.
It is the point at which conversations briefly stall. People buy property to build something up — not to talk about their own death. That is precisely why it is regularly overlooked.
The problem
For assets located in the United Arab Emirates, the succession law of your country of residence or origin does not apply automatically. Without express provision, local law may govern — with a distribution that can differ considerably from your intentions.
In practice something else often weighs more heavily: until jurisdiction is settled, accounts can be frozen and dealings with the property blocked. For family members already in a difficult position, that means months of uncertainty — and cost.
What a registered will achieves
For non-Muslim owners there are registration options that settle exactly this question bindingly. What is recorded is who inherits and who administers the estate.
The effort is modest: a document, a registration and a fee — not a procedure lasting months.
What it settles: the allocation of your assets located in the UAE and the appointment of the person who will administer them. For families with minor children it additionally covers guardianship during their time in the country.
What it does not settle: your estate planning as a whole. A UAE will does not replace a will in your country of residence — and the two must not contradict each other. That is exactly where mistakes arise when both documents are drawn up independently.
The practical advice
Settle this point before the purchase, not after. Not because the legal position would be different, but because afterwards, in experience, it simply gets left.
And have both wills aligned with one another. Two documents that contradict each other are worse than one.
